1. Agreement and operator
These Terms of Use (“Terms”) are an agreement between you and Kemph Ventures, LLC, the operator of Velocity Rating (“Velocity Rating,” “we,” “us,” or “our”). By creating an account or using velocityrating.com, the Velocity Rating iOS app, or related services (collectively, the “Service”), you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you are authorized to accept these Terms for that organization.
2. Eligibility and accounts
- Provide accurate, current information and keep it updated.
- Protect your password, mobile device, backup codes, and account session.
- Do not share credentials or allow an unauthorized person to use your account.
- Notify us promptly if you suspect unauthorized access.
- If you are not legally able to enter this agreement on your own, use the Service only with the involvement and permission of a parent, guardian, or other legally authorized person.
3. Contact confirmation is not account approval
Email codes, mobile codes, two-factor authentication, and relationship confirmations prove only the specific contact or relationship step they are designed to confirm. They do not verify your identity for Velocity Rating purposes and do not grant private profile or workspace access.
Every Athlete, Athletic Department / GM, and NIL Collective account must be reviewed and explicitly approved by a Velocity Rating administrator. We may call the applicant or an organization, request more information, decline a claim, return an account to review, or revoke access when verification can no longer be supported. Administrator access and View As capabilities are restricted and audited.
Organization payment is a separate requirement. Payment does not approve or verify an account, and approval does not create a paid entitlement. Private organization access requires completed security, administrator approval, and an active applicable subscription.
4. Velocity Rating and reports
Velocity Rating is a directional decision-support signal based on available performance, media exposure, social, and public-risk evidence. It is not an appraisal, market valuation, credit score, legal or compliance determination, tax or financial advice, employment recommendation, or guarantee of a deal, payment, eligibility outcome, or future result.
Data can be incomplete, delayed, conflicting, or incorrect, and models and methodologies can change. You are responsible for reviewing source evidence, freshness, limitations, and applicable laws and policies before making a decision. Do not use the Service as the sole basis for a high-impact decision about an athlete.
5. Public profiles and protected information
The overall Velocity Rating and public-safe athlete identity information may be publicly available. Private components, reports, risk information, representation details, notes, organization analytics, and other protected content may be accessed only when the Service authorizes your account and relationship. You may not bypass, probe, scrape, or attempt to defeat those controls, or disclose protected content outside the scope for which access was granted.
6. Acceptable use
You must not:
- Impersonate another person or misrepresent an identity, role, school, or relationship.
- Submit information you lack the right or permission to provide.
- Harass, exploit, discriminate against, threaten, or harm an athlete or another user.
- Use private information for an unauthorized recruiting, employment, eligibility, or commercial purpose.
- Reverse engineer, disrupt, overload, automate extraction from, or interfere with the Service.
- Upload malicious code or use the Service for unlawful, deceptive, or fraudulent activity.
- Remove report labels, confidentiality marks, source attribution, or material limitations.
7. Your content and corrections
You retain rights you hold in information and content you submit. You grant us a limited, nonexclusive license to host, process, reproduce, display, and use that content as needed to operate, secure, and improve the Service and provide the features you request.
You are responsible for the accuracy and lawfulness of submitted content. Athletes can use available profile and social tools to contribute or correct information, and anyone can contact support@velocityrating.com to report a factual concern. A correction request does not guarantee removal of accurate information lawfully obtained from public or licensed sources.
8. Organization subscriptions
Paid plans are offered to verified Athletic Department / GM and NIL Collective organizations. Pricing, billing interval, and renewal terms are presented before checkout. Stripe processes payment, and subscriptions renew until canceled under the terms shown at checkout.
Canceling stops future renewal but does not retroactively refund charges unless required by law or stated otherwise. Deleting an account first attempts to cancel any active subscription. If cancellation cannot be completed, account deletion stops so billing is not orphaned and you can retry or contact support. Subscription status never substitutes for administrator approval.
9. Velocity Rating materials
The Service, including its software, design, branding, methodology, models, reports, and compilations, is owned by us or our licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose. No other rights are granted.
10. Third-party services and sources
The Service depends on third-party data, links, communications, payment, analytics, hosting, and platform services. We do not control third-party services and are not responsible for their availability, content, policies, or independent acts. Source attribution does not imply a partnership or endorsement unless we expressly state otherwise.
11. Suspension, termination, and deletion
You may stop using the Service and may delete your account through the in-app account-deletion flow. We may restrict, suspend, return to review, or terminate access when reasonably necessary to protect the Service or others, investigate a verification concern, address nonpayment, comply with law, or enforce these Terms. Provisions that by their nature should survive termination do so.
12. Disclaimers and limits
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Service or any data, rating, report, or source will always be accurate, complete, current, secure, or uninterrupted.
To the maximum extent permitted by law, Velocity Rating and Kemph Ventures, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Changes and contact
We may update these Terms as the Service changes. We will post revised Terms here and update the date above. Continued use after revised Terms take effect means you accept them, to the extent permitted by law.
